The onsite sales rep is there to sell the builder’s product. They are generally very helpful in getting you excited about the product, explaining all the options and getting you on board. You are entering into a contract to build one of your biggest investments. The builder contracts are always written in favor of the builder. You need to know what this means for you financially. Are you getting a loan? Are the builders incentives tied to the lender they want you to use? How do you weigh that benefit compared to the underlying costs of the loan? What’s included in the price of the home. Do you understand the market enough to balance the costs of options and upgrades to market value? What happens when you choose all your dream finishes at the design center but it puts you over budget (happens all the time!). What happens when the lender appraises the property?
There are two parties in a home sale transaction – the seller and the buyer. What is important to understand with new construction is that the sales agent at the model home represents ONE side of the transaction – the seller side. They represent the best interest of the BUILDER. Of course they are nice , knowledgeable and will do their best to provide great customer service, but you need someone representing you, the buyer, on the other side of the transaction. Builders are not held to the same rules and regulations by the State when it comes to representation and contracts. You could be walking into one of the largest purchases of your life without someone who has your best interests in mind. Negotiating upgrades, reviewing contracts and identifying hidden fees are just a few of the ways a real estate agent can help when purchasing a new build.
One important thing to be aware of is that the builders use their own contracts. Resale homes use contracts promulgated by the Texas Real Estate Commission (TREC), that offer a lot of consumer protections. Builders contracts are written by and for the builder.
